Terms + Conditions

 

These terms and conditions, together with the provisions set forth on the Client Contract, form a legal agreement (“Agreement”) as if they were part of one and the same document between Client and Your Home Concierge.  This Agreement is valid when the Client Contract is signed and returned to Your Home Concierge, unless otherwise noted in the Client Contract.

 

Hours of Operation:

 

8:00 AM-6:00 PM Monday- Friday  (excluding holidays)

 

Services after the hours of operation or on holidays may be available upon request, but shall be subject to the vendor rate.

 

Payment:

 

1) We accept cash, check, and online payments. A $30 fee shall be charged for all returned checks.

 

2) Non-membership plan services are priced a la carte based on the services requested. Any additional costs incurred at Client’s request, including vendor products and services, shall be billed directly to Client.

 

3) Client agrees to provide at least 24 hours advance notice to cancel any scheduled services. Failure to cancel scheduled services with advance notice may result in the full price of the service being charged.

 

 

 

Membership Plan Services

 

1) Each membership plan requires a one-year subscription unless otherwise specified on the Client Contract. The subscription shall renew automatically unless cancelled in writing prior to the renewal date. Client shall not be notified of an upcoming renewal.

 

2) Membership plans do not include services after the hours of operation or during holidays.

 

Other terms and conditions:

 

1) Unless otherwise specified, the laws of the State of Colorado shall govern this Agreement.

       

2) The Client Contract may modify the applicability of these standard terms and conditions.  To the extent of any conflict, the Client Contract shall control.

 

3) Your Home Concierge reserves the right to change, modify, add, or remove (collectively “changes”) portions of these terms and conditions contained herein at any time. If there is any conflict between these terms and conditions and the terms and conditions posted on the Your Home Concierge website, the terms and conditions posted on the website shall control. Your continued use of services following any changes reflected on the terms and conditions posted on the Your Home Concierge website shall represent your consent to such changes.

 

4) Unless otherwise agreed to in writing, the “Client” is the person to whom the Client Contract is addressed. This Client warrants his or her authority to contract with Your Home Concierge.

 

5) Payment is due from the Client as provided in the Client Contract or upon receipt of the invoice from Your Home Concierge unless other arrangements are made in writing with Your Home Concierge.  Your Home Concierge reserves the right to charge a late fee of percent 3% per month on all invoices that are not paid by the Client within thirty (30) days of the invoice date. The Client agrees to pay all collections costs, including, without limitation, any legal fees and expenses incurred in connection with the collection of a past due account.  In the event of any nonpayment by the Client hereunder, Your Home Concierge may immediately suspend further performance under this Agreement.

4) Unless otherwise agreed to in writing, the “Client” is the person to whom the Client Contract is addressed. This Client warrants his or her authority to contract with Your Home Concierge.

6) Unless expressly agreed to in writing by Your Home Concierge, any hourly fee estimates for services are for the Client’s budgeting purposes only, and such estimates are not binding upon Your Home Concierge under this Agreement.

 

7) Your Home Concierge is not responsible if products and/or vendors are not available at the requested time of service.

 

8) Your Home Concierge will do its best to handle the task requested; however, there will be circumstances in which a request is unable to be fulfilled, and Your Home Concierge shall not be liable for any consequences in connection therewith.

 

9) Your Home Concierge is not responsible for any purchases made on Client’s behalf but will work with the Client and Vendor to resolve any issues.

 

10) Client must provide Your Home Concierge full access to Client’s residence or jobsite in order to conduct services. Failure to provide access may result in the full price of the service being charged. No services shall be provided by Your Home Concierge or its vendors at Client’s residence or jobsite if a person under the age of 18 is present unless another person age 18 or older is present at all times.

 

11) In an effort to resolve any conflicts that may arise related to the services provided by Your Home Concierge hereunder, the Client and Your Home Concierge agree that all disputes between them arising out of or relating to the services so provided by Your Home Concierge shall be submitted to non-binding mediation, unless the parties mutually agree otherwise in writing.  Non-binding mediation shall be completed within ninety (90) days from the date such dispute arises. In the event that mediation is unsuccessful, such disputes shall be submitted to a court of competent jurisdiction in the City and County of Denver, Colorado, which shall be the appropriate jurisdiction and venue for any and all claims or disputes arising out of this Agreement.

 

12) To the fullest extent permitted by law, and notwithstanding any other provision of this Agreement to the contrary, the total liability, in the aggregate, of Your Home Concierge and its members, officers, employees, and agents, and any and all of them, to the Client, for any and all claims, losses, costs or damages of any nature whatsoever, including but not limited to attorneys’ fees, legal costs and expert-witness fees and costs, or for any and all expenses resulting from or in any way related to the services or this Agreement from any cause or causes, shall not exceed the total compensation received by Your Home Concierge from the Client. It is intended that this limitation shall apply to any and all liability or cause of action between the parties hereto, however alleged or arising under this Agreement, unless otherwise expressly prohibited by law.

 

13) In no event shall Your Home Concierge and its members, officers, employees, and agents, and any and all of them be liable for any indirect, incidental, consequential, or punitive damages or damages resulting from loss of profits, lost data, or business interruption arising out of the use, inability to use, or the results or the use of the services, and Client agrees to indemnify, defend, and hold harmless Your Home Concierge and its members, officers, employees, and agents, and any and all of them, and their respective successors and assigns, if any, from and against all claims, losses, costs or damages of any nature whatsoever, including but not limited to attorneys’ fees, legal costs and expert-witness fees and costs, arising from or related to the same.

 

14) It is understood and agreed by the parties hereto that, if any part, term, condition or provision of this Agreement is held by the courts to be illegal or in conflict with any law or statute of the State of Colorado, then the validity of the remaining portions or provisions shall not be affected, and the rights and obligations of the parties shall be construed and enforced as if this Agreement did not contain the particular part, term, condition or provision so held to be invalid.

 

15) Your Home Concierge reserves the right to terminate this Agreement and/or cease the continued provision of services for any reason, including but is not limited to dangers imposed to the health or safety of vendors, any omissions or misstatements of fact by the Client relating to the services, or requests to engage in unethical or illegal behavior or activities.


16) Your Home Concierge is committed to honoring the Client’s privacy. All personal information obtained is gathered for the purpose of providing concierge services and billing the Client for services rendered. At no time shall any collected information be sold to a third party without the Client’s authorization, and shall only be disclosed in connection with providing services to the Client under this Agreement.
